Terms of Service

These Terms of Service govern the contractual relationship between you as the user and us as the provider of the Callday app and the callday.io website.

Callday is operated from Germany. Because of that, German law applies to this agreement (see Section 10). We've kept English here so the terms are accessible for our US-based users — the legal substance is identical to the German version at callday.io/terms/de.

2. Scope

These terms apply to the use of the Callday iOS app, the website, and all related services. By creating an account or joining the waitlist, you confirm that you have read and accepted these terms.


3. Services

Callday provides software for structuring cold-calling workflows. Features include, among others:

4. Account and Access

A user account is required to use the app. Registration is via email/password, "Sign in with Apple", or Google sign-in. You agree to:

6. Pricing and Payment

6.1 Renewal

The subscription renews automatically at the end of each billing period for the same duration unless cancelled beforehand. For Apple subscriptions, Apple's cancellation deadlines and channels apply additionally.

6.2 Cancellation and Pause

You can end your subscription at any time:

As an alternative to cancellation, you can pause your subscription — access is suspended, your data (lead lists, call outcomes) is retained, and you can resume later without re-importing. Pauses can be activated via the account settings.

6.3 Right of Withdrawal

Consumers have a 14-day right of withdrawal (§ 355 of the German Civil Code (BGB)). The withdrawal period begins when the contract is concluded. You can expressly consent to the service starting before the withdrawal period expires — in which case your right of withdrawal expires when the contract has been fully performed (e.g. first login after subscription).


7. Liability

We are liable without limitation in cases of intent and gross negligence, in cases of injury to life, body, or health, and under the German Product Liability Act.

In cases of simple negligence, we are only liable for the breach of material contractual obligations (cardinal obligations), and limited to foreseeable damages typical for this type of contract.

Callday is a software tool — the success of your cold-calling activities depends on many factors outside our control. We do not guarantee specific results (e.g. number of booked appointments, conversion rates, etc.).


8. Termination

Both parties may terminate the contractual relationship at any time without notice. You can terminate by deleting your account in the app. Paid subscriptions continue until the end of the paid period unless otherwise agreed.


9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration body.


10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If individual provisions of these Terms of Service are invalid, the remaining provisions remain effective.

We may change these Terms of Service for objective reasons (e.g. changed legal situation, new features). We will notify you of material changes by email or upon the next app launch.
